Terms of Service

These Terms of Service ("Terms") are an agreement between KidFounder.ca ("Kid Founder", "we", "us", "our") and you, governing your use of app.kidfounder.ca and the Kid Founder learning platform (the "Service") โ€” an online course that teaches you to plan, build, and launch a real web-app business, with a gamified lesson path and an AI Mentor.

By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Service.

1. Who can use Kid Founder

The account holder must be at least 18 years old (or the age of majority where they live) and able to enter into a binding contract.

Kid Founder is made for young founders too. If a learner is under 18, a parent or legal guardian (18+) must create and control the account, agree to these Terms on the learner's behalf, and add a learner profile for that child. The adult account holder is responsible for the account and for all activity on every profile under it, including minors'. Children do not create their own accounts.

2. Your account

Provide accurate information and keep it current. Keep your password confidential โ€” you're responsible for activity under your account. Tell us right away at support@kidfounder.ca if you suspect unauthorized use. Kid login (username + PIN) is a convenience for a child to use their own profile under the adult's account, not a separate account.

3. The course and the AI Mentor

The Service provides educational lessons, projects, and an AI Mentor โ€” an automated assistant powered by a third-party AI provider. The AI Mentor is a learning aid: it can be wrong, it does not provide professional legal, financial, tax, or safety advice, and you should verify anything important. Never paste passwords, API keys, or other secrets into the chat. We may add, change, or remove content and features to improve the Service.

4. Payments, free trial, and access

  • Free trial. New accounts get a free trial (currently 14 days) with access to the course.
  • Paid access. Full access is offered for a fee (currently $299 CAD per year, or the price shown at checkout). This is a one-time payment that grants access for the stated period to the learner profiles on your account; it is not an automatically-renewing subscription, and access ends when the period ends unless you purchase again.
  • Processing. Payments are handled by Stripe; by paying you also agree to Stripe's terms. We never receive or store your full card number.
  • Price changes. We may change prices; changes apply to new purchases, not to a period already paid for.

5. Refunds โ€” 14-day money-back guarantee

We want you to be happy with Kid Founder. If it isn't the right fit, email support@kidfounder.ca within 14 days of your payment and we'll give you a full refund of that payment.

  • The 14-day guarantee applies to your first purchase and to each renewal payment, counted from the date of that payment.
  • Approved refunds are returned to your original payment method, usually within 5โ€“10 business days.
  • After 14 days, payments are non-refundable โ€” including for any time remaining in your access period.
  • Your free trial is free, so nothing is charged and nothing needs refunding during it.
  • We may decline a refund where the guarantee is being misused (for example, repeatedly buying and refunding to copy course content).

This guarantee is in addition to any rights you have under applicable consumer-protection law, which we don't take away.

6. Your content

You keep ownership of what you create in the Service (project notes, answers, boss-level submissions). You grant us a limited license to store, process, and display that content as needed to operate the Service โ€” for example, showing a child's submission to their parent for sign-off. Don't upload content that is unlawful, infringing, or contains other people's personal information without permission.

7. Acceptable use

You agree not to: share, resell, or transfer your account or access; copy, scrape, redistribute, or republish the course content; reverse-engineer or attempt to breach the security of the Service; harass or harm others; or use the AI Mentor or any feature to create unlawful, harmful, or abusive content. We may limit or suspend accounts that abuse the Service.

8. Our intellectual property

The Kid Founder course, brand, text, graphics, and software are owned by us or our licensors. We grant you a personal, non-exclusive, non-transferable license to use them for your own learning. All other rights are reserved.

9. Third-party services

The Service uses third parties including Google (optional sign-in), Stripe (payments), our AI provider (Mentor), our push provider, and our email provider. Your use of those features is also subject to those companies' terms and privacy practices.

10. Suspension and termination

We may suspend or end your access if you breach these Terms or to protect the Service or others. You may stop using the Service at any time. When access ends, your license to use the content ends and your data may be deleted in line with our Privacy Policy.

11. Disclaimers

The Service is provided "as is" and "as available." We don't guarantee that using it will make you money or produce a successful business โ€” outcomes depend on you. To the fullest extent allowed by law, we disclaim all warranties, express or implied.

12. Limitation of liability

To the fullest extent permitted by law, our total liability for any claim relating to the Service will not exceed the amount you paid us in the 12 months before the claim. We are not liable for indirect, incidental, special, or consequential damages, or lost profits or data.

13. Indemnification

You agree to indemnify and hold harmless KidFounder.ca from claims, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your content, or your breach of these Terms.

14. Changes to these Terms

We may update these Terms. We'll post the new version here with an updated date and, for material changes, notify you by email. Continued use after the changes take effect means you accept them.

15. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, without regard to conflict-of-law rules. The courts located in Ontario will have jurisdiction, except where you have non-waivable rights under the consumer law of your home province or country.
